Terms And Conditions

Your use of the Safe Snaps service is covered by the following terms and conditions. You will be required to agree to the following terms and conditions during registration for the service. Refusal to agree to these terms and conditions will prevent Safe Snaps accepting you as a customer.

1. Absolutely no obscene, pornographic or illegal images of any kind may be stored on the Safe Snaps servers. Should Safe Snaps find any such material your account will be immediately suspended, the offending material removed and the appropriate authorities contacted. Safe Snaps will always cooperate fully with the authorities in their attempt to gain conviction for the storage or distribution of illegal material.
2. Copyright of all material sent to or through the Safe Snaps servers must be owned, or legally licensed by you.
3. Copyright of all material sent to or through the Safe Snaps servers remains your property. Safe Snaps makes no claim, express or implied, to the copyright of material you send through its servers.
4. The Safe Snaps monthly account fee is £4 (four Pounds Sterling) or $6.95 (six US Dollars and ninety five cents) for one calendar month.
5. The Safe Snaps service runs for one calendar month in return for one payment of the monthly account fee.
6. Payment for Safe Snaps services must be made by a Safe Snaps approved method.
7. Services provided by Safe Snaps are available only to Safe Snaps customers, and only upon receipt of the monthly service fee.
8. All Safe Snaps customers must register for use of the service at the company web site.
9. Use of a Safe Snaps account is restricted to a single household but there is no restriction on the number of computers you may use.
10. You may have more than one account per household should you so choose, but each account will be subject to the monthly account fee. Multiple accounts within a single household will be treated by Safe Snaps as completely separate accounts and no information will be shared between them or the account holders.
11. Registration and payment for the Safe Snaps service does not imply any obligation to continue as a Safe Snaps customer beyond one calendar month.
12. Failure to pay the monthly service fee will be taken as an indication you wish to cancel your Safe Snaps service.
13. You may cancel the Safe Snaps service at any time with no further obligation.
14. No refund for the current calendar month will be given if the Safe Snaps service is cancelled. This does not violate any statutory rights that might entitle you to a refund should the service be deemed not fit for purpose.
15. If you request cancellation of the Safe Snaps service the service will remain in effect, and you will be considered a customer, through to the end of the current charging period. Your right to access the service will then lapse.
16. Your registration for the Safe Snaps service expressly implies agreement for the monthly account fee to be automatically charged and electronically debited via your chosen payment method until you cancel the service.
17. Safe Snaps reserves the right to move the charging date for your account to one of its convenience at its own cost and at any time. In this event you may be given one or more free days of Safe Snaps service.
18. From time-to-time it may be necessary for Safe Snaps to increase the monthly account fee. Safe Snaps will give not less than one calendar month's notice of such increases. In this event you will be under no obligation to remain as a Safe Snaps customer and your right to cancel will not be affected. If after the expiration of any such notice period you have not cancelled the service you will be deemed to have agreed to the account fee increase and to have given Safe Snaps authorisation to take payment by your usual method and at the increased rate.
19. After cancellation, or lapse through non-payment, Safe Snaps will make a best effort to retain your data files. Safe Snaps make no guarantee to keep data files for lapsed accounts and explicitly reserves the right to remove such data files, or move them to off-line storage of its choosing.
20. In order to reactivate a cancelled or lapsed account you will be required to pay the monthly account fee for every month during which the account was lapsed. Note that this arrears charge will be calculated based on the monthly service charge in effect at the time account restoration is requested. Account reactivation may also incur a one off reactivation fee.
21. Safe Snaps reserves the right to levy an account reactivation charge, currently £25 (twenty five pounds sterling), to retrieve customer files from off-line storage. Safe Snaps may waive the reactivation fee at its sole discretion.
22. Safe Snaps reserves the right to cancel any account subscription, or refuse any account reactivation, at its sole discretion and at any time.
23. From time-to-time Safe Snaps may require that you install an updated version of the Safe Snaps software. You agree to perform these necessary upgrades within the reasonable time specified by Safe Snaps when it informs you of this requirement. Safe Snaps reserves the right to refuse service to you should you fail to perform the necessary upgrade. Should your account be suspended for this reason your access to the web site will not be affected and account cancellation requests will be honoured.
24. Safe Snaps will provide software that must be installed on all your computers that will make use of the Safe Snaps service. The cost of this software is included in the monthly account fee. Safe Snaps guarantees to never make an additional charge for this software.
25. Safe Snaps supports only computers that run one of x86 Linux, Windows 2000 or Windows XP. Use of Safe Snaps software on other computing platforms is not supported and is expressly forbidden.
26. The Safe Snaps service is not available to professional photographers or for corporate use. Safe Snaps reserves the right to terminate your account should it deem you to be such a user. Such a determination will be at Safe Snaps sole discretion.
27. Safe Snaps imposes no limit on the amount of storage your account may use, however Safe Snaps reserves the right to impose such a limit at any time and at its sole discretion.
28. As a Safe Snaps customer you must obey all local laws regarding acceptable on-line content, in addition to any further restriction specified in these terms and conditions.
29. Any attempt by you or your agents to hack, or otherwise illegally gain access to, the systems of Safe Snaps or its affiliates will result in immediate suspension of your account and prosecution to the fullest extent available in law.
30. You must not violate any laws in your jurisdiction, including copyright laws, in your use of the Safe Snaps service.
31. You agree that Safe Snaps cannot be held responsible for the content you transfer to its servers.
32. Safe Snaps reserves the right to remove any file, or account, from its servers at any time that at Safe Snaps sole discretion is determined to be offensive, illegal, threatening, defamatory, libellous, obscene, violates third party copyright, or is damaging to Safe Snaps in any way.
33. Safe Snaps reserves the right for any of its employees to view your images for the sole purpose of inspecting for illegal or other content that breaches these terms and conditions.
34. Safe Snaps reserves the right to remove all files and other account data from cancelled, suspended or lapsed accounts at any time.
35. Safe Snaps is a best effort service, no guarantee, express or implied, is made that Safe Snaps Ltd., will not lose your data. Safe Snaps accepts no responsibility for loss of your data, or any commensurate loss of property or income.
36. You agree to indemnify and hold Safe Snaps harmless relating to any matter arising from your use of any Safe Snaps service.
37. Safe Snaps reserves the right to modify these terms and conditions at any time. Should such a modification become necessary you will be informed via e-mail before the change takes affect
38. The Courts of England and Wales shall have exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with this Website, its use, the Safe Snaps service and these Terms and Conditions. Some of the information in the pages contained in this Website is not to be accessed from certain jurisdictions and no representation or warranty is made as to whether the information available in this Website complies with the regulatory regime of countries from which the pages in this Website should not be accessed.
39. Any provision in these Terms and Conditions that is found to be unenforceable will be limited or deleted to the minimum extent necessary so that the remaining terms remain in full force and effect.
40. Use of this Website and these Terms and Conditions shall be subject only to the laws of England and Wales which shall exclusively govern the interpretation, application and effect of all the above permissions, exclusions, licences and conditions of use.
